Terms and Conditions – "Joly Drive" App *Last updated:* August 31, 2026 Welcome to "Joly Drive." Please read these Terms and Conditions carefully before using the app, as your use of it constitutes explicit and binding agreement to everything contained herein. ## 1. General Definitions - **The App / Platform:** Refers to the "Joly Drive" application with all its services (smart transportation, delivery, classified ads) via mobile phone or website. - **The Operating Company:** The entity owning and operating the app within the Arab Republic of Egypt. - **The User:** Any person who downloads the app, registers on it, or uses any of its services, whether as a rider, delivery requester, advertiser, or visitor. - **The Driver / Service Provider:** The person registered on the app to provide transportation or delivery services independently. - **The Advertiser:** Any user who posts a classified ad (sale, purchase, rental, jobs, etc.) through the app's classifieds section. ## 2. Nature of the Service "Joly Drive" provides two services within the Arab Republic of Egypt: 1. **Smart Transportation:** Connecting riders with independent drivers to provide transportation trips via the app. 2. **Classified Ads:** An electronic space that allows users to post ads for selling, buying, or renting goods and services. **Important Notice:** "Joly Drive" operates as a *technical intermediary* connecting the parties (user/driver/advertiser), and is not considered a transportation company or an actual carrier, nor a party to any sale or purchase transaction conducted through the classified ads, except with respect to its contractual obligations set out in this document. ## 3. Registration and Account Use Conditions - The user must be **18 years of age or older**, or use the app with a guardian's permission. - The user is obligated to provide accurate and correct information upon registration (name, phone number). - Creating more than one account for the same person without the company's permission is prohibited. - The user bears full responsibility for the confidentiality of their account information (password, access code) and for any activity carried out through it. - The company reserves the right to suspend or cancel any account that violates these terms without prior notice in serious cases. ## 4. Terms Specific to Transportation and Delivery Services ### 4.1 For Riders/Delivery Requesters - The fare is determined automatically by the app based on distance. - The user must be present at the specified time and place; cancellation or waiting fees may be applied according to the app's published policy. - Using the service to transport prohibited, dangerous, or illegal materials is forbidden. ### 4.2 For Drivers - The driver must hold a valid driving license, the vehicle licenses legally required, and mandatory insurance in accordance with the laws of the Arab Republic of Egypt. - The driver is an **independent contractor**, not an employee of "Joly Drive," and is responsible for their own tax and insurance obligations. - The driver must treat users with respect and comply with traffic rules and transportation laws in effect in Egypt. - The company reserves the right to review the driver's ratings and suspend them in case of repeated complaints or violations of the terms. ### 4.3 Liability - The company exercises due diligence to ensure service quality, but is not liable for damages resulting from the misconduct of a third party (driver or user) outside its technical control, while committing to cooperate in any legal investigation when needed. - In the event of an accident during a trip, the matter is subject to the provisions of mandatory vehicle insurance and relevant Egyptian laws. ## 5. Terms Specific to Classified Ads - The advertiser is obligated to ensure that the advertised content (images, descriptions, prices) is **accurate and lawful** and does not violate public morals or Egyptian laws. - Posting ads that include: counterfeit goods, weapons, narcotics, adult content, financial fraud, or any illegal activity is prohibited. - "Joly Drive" does not guarantee the accuracy or validity of ads posted by users, and any transaction (sale/purchase) conducted directly between the parties is at their own responsibility. - The company reserves the right to remove any violating ad without prior notice, and to suspend the advertiser's account in case of repeated violations. - The company may charge fees for certain advertising services (highlighting an ad, top placement, etc.), which will be clarified within the app before payment. ## 6. Payment and Invoicing Available payment methods include: cash payment, bank cards, or electronic wallets available within the app. - All displayed prices include (or exclude, as clarified in the app) value-added tax in accordance with Egyptian laws. - In the event of a billing error, the user has the right to contact customer service to correct it within a reasonable period. ## 7. Cancellation and Refunds - The user has the right to cancel the order/trip before its execution begins, and cancellation fees may apply according to the published policy. - For the classified ads service, paid ad fees are non-refundable after the ad is published, except in cases of a technical error confirmed by the company. ## 8. Privacy and Data Protection - The company is committed to protecting users' data in accordance with **Egyptian Personal Data Protection Law No. 151 of 2020** and its amendments. - Geographic location data (GPS) is collected solely for the purpose of operating the transportation and delivery services. - User data is not shared with third parties except to the extent necessary to provide the service or pursuant to an official request from the competent legal authorities. - For more details, please review the app's **Privacy Policy** (a separate document). ## 9. Intellectual Property All rights related to the "Joly Drive" logo, app design, software code, and associated content are owned by the operating company, and may not be copied or reused without prior written permission. ## 10. Modification of Terms The company reserves the right to modify these Terms and Conditions at any time, and the user's continued use of the app after the amendments are published is considered implicit acceptance of them. It is recommended to review this page periodically. ## 11. Termination of Service The company has the right to suspend or terminate the account of any user who violates these terms, misuses the service, or provides false information, without the need for prior notice in serious cases, while reserving the company's right to take legal action when necessary. ## 12. Governing Law and Dispute Resolution These Terms and Conditions are governed by the provisions of **Egyptian law**, and the courts of the Arab Republic of Egypt have jurisdiction to settle any dispute arising from the use of the app, unless otherwise agreed. ## 13.
